1. About These Terms

These Terms & Conditions ("Terms") govern your use of https://themenopausecoach.com/ (the "Website") and your purchase, access to and use of programmes, consultations, coaching, digital materials, workshops and other services offered through The Menopause Coach ("TMC"). The Menopause Coach is operated by Natural Optimum Health Ltd., a limited company registered in Northern Ireland.

In these Terms, references to "TMC", "The Menopause Coach", "we", "us" and "our" mean Natural Optimum Health Ltd., trading as The Menopause Coach, where appropriate. By purchasing or using our services, you agree to these Terms. Please read them carefully before making a purchase.

2. Eligibility, Age and Capacity

TMC services and programmes are intended for adults aged 18 years and over. By purchasing, accessing or participating in a TMC programme or service, you confirm that you are at least 18, have legal capacity to enter a binding agreement, understand the nature of the service and provide information that is accurate to the best of your knowledge. We may refuse or discontinue services where we reasonably believe these requirements are not met.

3. Our Services

TMC provides menopause-related educational, informational, coaching and wellbeing programmes and services. Depending on the service selected, this may include self-guided programmes, educational videos and digital content, individual consultations, personalised plans, one-to-one or group coaching, online sessions, workshops, tutorials and supporting educational resources. Additional online services, including recommendation for other wellness products, are also available, and may or not be included in the fee depending on the programme you enrolled in, and are not refundable through TMC. Before purchasing any other online services or material products, it remains your responsibility to ensure that they are suitable and appropriate for you, please consult with your appropriately qualified healthcare professional as they are not intended to replace medical diagnosis, treatment or advice from an appropriately qualified healthcare professional.

The features, duration, content, delivery method and price are those stated on the Website or otherwise communicated at purchase.
We will provide our services with reasonable care and skill, as required by the Consumer Rights Act 2015.

4. Important Health and Medical Disclaimer

TMC provides educational, informational, coaching, lifestyle and wellbeing services. Information and services provided through TMC are not intended to replace medical diagnosis, treatment or advice from an appropriately qualified healthcare professional.

You should seek appropriate professional medical advice about medical conditions, symptoms, diagnoses, medications or treatment, and should not disregard or delay professional care solely because of information obtained through TMC. If you believe you are experiencing a medical emergency, contact the appropriate emergency medical service immediately.

No doctor-patient, clinician-patient or regulated healthcare relationship is created by your use of our services. Natural Optimum Health Ltd. trading as TMC are natural-therapy practitioners, not medical doctors. Any food-sensitivity or intolerance testing or other services offered through TMC is an informational wellness tool and is not a medical diagnostic test; always discuss results with your GP or a qualified healthcare professional.

5. Individual Results

Every individual is different. Menopause symptoms, health, nutrition, lifestyle, personal circumstances and responses vary. We are unable to and cannot guarantee any particular result or outcome.

Testimonials and case studies represent individual experiences and are not guarantees of similar results or outcomes.

6. Your Responsibilities

Decide whether a TMC programme or service is appropriate for you and seek professional medical advice where required.

Provide information that is accurate and complete to the best of your knowledge.

Follow reasonable programme and participation instructions and treat other participants and TMC personnel respectfully.

Use TMC materials only for permitted personal purposes.

Remain responsible for your own decisions and actions concerning your health, lifestyle and wellbeing.

7. Orders and Contract Formation

Website information about programmes or services is an invitation to purchase. When you place an order, you offer to purchase the selected service subject to these Terms. A binding contract is formed when we accept or confirm your purchase, subject to applicable consumer law. We may refuse an order where a programme is unavailable, material pricing information is incorrect, payment cannot be authorised, fraud or misuse is reasonably suspected, or we cannot lawfully or appropriately provide the service. If payment has been taken for an order we cannot accept, we will arrange an appropriate refund.

8. Prices and Payment

Prices will be displayed or communicated before purchase. You agree to pay the stated price and any clearly disclosed applicable charges. Payment may be processed by an independent third-party provider. Where instalments or payment plans are offered, you agree to the schedule accepted at purchase. Unless otherwise stated, a payment plan does not convert the purchase into separate monthly purchases.

Prices are presently exclusive of VAT — we are not VAT-registered. The full total price, including all charges, is shown before you complete payment.

If you validly cancel a contract paid for by instalments, future instalments will cease and you will only be required to pay for services already performed up to the date of cancellation, where permitted by law.
If you validly cancel a contract paid in full, we reserve the right to proportion any refund due, based on the date of cancellation.
The program you contracted for requires your participation and as such failure to participate may result in a proportional refund.

9. Digital Content and Programme Access

Some programmes include videos, recordings, documents, guides, worksheets, downloads and other digital materials or physical materials as may be suggested on occasions. Access is for your personal, non-commercial use only and may be limited to the period stated at purchase. You must not share login details, restricted links or paid materials with another person.

Where digital content is defective, we will provide a remedy (repair, replacement or a proportionate refund) in accordance with the Consumer Rights Act 2015.

10. Online Consultations and Sessions

Consultations, coaching sessions, workshops and group sessions may be delivered remotely. You are responsible for a suitable internet connection, compatible equipment, an appropriate environment and reasonable steps to protect your privacy. We are not responsible for interruptions caused by your equipment, connection or circumstances outside our reasonable control. If a session cannot take place because of a technical problem on our side, we will take reasonable steps to rearrange it where appropriate.

Recording policy:

We do not record one-to-one consultations without your prior express consent. Where we record a group session (for example, for participants who cannot attend), the recording is shared only with registered participants of that programme, and you may ask us not to include your image or contributions. It is recommended you may turn off/close your camera to ensure your image is not included. You must not record any session yourself without the prior permission of TMC and all other participants.

11. Appointment Cancellations and Rescheduling

Where a programme includes scheduled individual consultations or sessions, please provide as much notice as reasonably possible if you need to cancel or rearrange. Any specific cancellation or rescheduling requirements communicated when booking form part of the terms applicable to that booking. Repeated missed appointments or cancellations may affect our ability to provide the service. Nothing in this section limits statutory cancellation or refund rights.

12. Statutory 14-Day Cancellation Rights

If you purchase as a consumer and enter into a contract with us online or otherwise at a distance, you may have a statutory right to cancel within 14 days without giving a reason, subject to applicable law and relevant exceptions. The way this right applies depends on what you purchase. Nothing in these Terms restricts a statutory cancellation right that applies to you.

13. Services Beginning During the Cancellation Period

You may request that a coaching, consultation or other service begins before the end of an applicable 14-day cancellation period. Where required by law, we will obtain the necessary request, consent or acknowledgement before beginning. If you validly cancel after requesting that services begin, you may be required to pay an amount proportionate to services already provided, where permitted by law. If a service has been fully performed following the required express request and acknowledgement, your statutory cancellation right may be affected or lost where applicable law provides for this.

14. Digital Content and Cancellation Rights

Different rules may apply to digital content supplied immediately and not on a tangible medium. Where required by law, before immediate access is provided during a statutory cancellation period, we may ask you to expressly consent to supply beginning immediately and acknowledge the effect on your cancellation right. We will not rely on a waiver or loss of statutory rights unless applicable legal requirements have been satisfied.

15. How to Exercise a Statutory Cancellation Right

Where you have a statutory right to cancel, notify us clearly that you wish to cancel using kieranthemenopausecoach@gmail.com. Include enough information to identify you and the relevant purchase. You may use the model cancellation form in Appendix A, but it is not obligatory.

We will issue any refund due within 14 days of receiving your cancellation notice, ordinarily using your original payment method unless we agree otherwise.

16. Refunds

Refund eligibility depends on the programme or service purchased, applicable statutory rights, whether services have begun or been performed, whether digital content has been accessed or supplied, and the circumstances of cancellation. Nothing in our refund arrangements excludes or limits a remedy to which you are legally entitled. Any separate programme-specific refund or cancellation policy should be read with these Terms; mandatory statutory rights prevail in the event of conflict.

17. Changes to Programmes and Services

We may make reasonable changes to programme content, schedules, resources, personnel, delivery methods or supporting materials to improve services, update information, respond to circumstances outside our reasonable control, comply with legal requirements or maintain quality and availability. We will not materially deprive you of the principal service purchased without taking appropriate steps to address the effect of the change.

If we have to cancel a group programme entirely (for example, because too few participants enrol), we will offer you a full refund or a transfer to an equivalent programme, at your choice.

18. Intellectual Property

Unless otherwise stated, the Website and TMC text, videos, recordings, graphics, infographics, programme structures, educational materials, guides, worksheets, downloads, presentations, branding, logos, photographs and other original materials are owned by or licensed to Natural Optimum Health Ltd. trading as The Menopause Coach and protected by applicable intellectual-property laws. A purchase grants only a limited, personal, non-exclusive and non-transferable right to access and use materials for personal purposes; ownership and intellectual-property rights do not transfer to you.

19. Prohibited Use of TMC Materials

Unless we give prior written permission or law expressly permits it, you must not reproduce or redistribute paid materials, share paid videos or downloads, provide another person access to restricted content, sell or commercially exploit materials, publicly upload paid content, modify materials for commercial redistribution, record private sessions without permission or represent TMC materials as your own. We may suspend or terminate access where there is reasonable evidence of material unauthorized use or distribution or misuse.

20. Group Programmes and Confidentiality

Participants in group services should respect the privacy and confidentiality of others. You must not record, publish, disclose or distribute another participant's personal information, experiences, comments, images or contributions without permission. Although we require appropriate conduct, we cannot guarantee the conduct of every independent participant, so exercise reasonable discretion when sharing personal information in a group setting. It is highly recommended to not use any chat box or question box on any platform or group service to share personal details or contact details.

Our confidentiality obligation: we will keep the content of your one-to-one consultations and your personal health information confidential. We will only disclose it where required by law or a competent authority, where necessary to protect you or others from serious harm, or with your consent. This obligation does not apply to information you choose to make public yourself.

21. Testimonials and Feedback

You may voluntarily provide feedback. We will not knowingly publish an identifiable testimonial containing personal information without an appropriate lawful basis and, where necessary, permission has been obtained. Additional care will be taken where a testimonial may reveal health-related information.

When we publish identifiable testimonials, that is only with the client's explicit consent, including consent to publish any health information they contain.

All testimonials published by us are genuine, from real clients, and are used with the client’s explicit consent; we do not commission, pay for or publish fake or misleading reviews.

22. Acceptable Use of the Website

You must not use the Website unlawfully or fraudulently; introduce malware; interfere with operation or security; attempt unauthorised access; infringe intellectual-property or privacy rights; harass or harm another person; or use the Website in a way that could materially damage TMC, Natural Optimum Health Ltd., the Website or other users.

23. Third-Party Websites and Services

The Website may link to independent websites, social networks, payment services, video platforms or other services. They may have their own terms and privacy policies. A link does not necessarily constitute endorsement, and we are not responsible for independent third-party content or operation except to the extent responsibility cannot lawfully be excluded.

24. Website Availability

We aim to keep the Website and online programme resources reasonably available but cannot guarantee uninterrupted or error-free access. Access may be restricted for maintenance, security, technical failures, hosting problems, updates or circumstances outside our reasonable control. Where a significant interruption affects a paid service, we will take reasonable steps to restore access or provide an appropriate alternative where reasonably possible.

25. Suspension or Termination

We may suspend or terminate programme or service access for a serious or repeated breach of these Terms, including unauthorized sharing of paid content, abusive or threatening behaviour, fraud, serious disruption, misuse or failure to make payments as and when due. Where reasonably appropriate, we will provide notice and an opportunity to remedy the issue. Any termination remains subject to applicable consumer rights.

26. Limitation of Liability

Nothing in these Terms excludes or limits liability whereby doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Subject to those protections, TMC is not responsible for losses caused solely by circumstances outside our reasonable control or by a user's failure to follow these Terms or obtain appropriate professional advice. Statutory consumer rights are unaffected.

27. Privacy and Personal Information

We process personal information in accordance with our Privacy Policy. Some TMC services may involve information concerning menopause, symptoms and health, which may receive additional protection under applicable data-protection law. Please read the Privacy Policy before providing personal information or participating in services.

28. Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by circumstances genuinely outside our reasonable control, such as serious telecommunications failures, natural disasters, government restrictions or widespread provider outages. Where such circumstances materially affect a paid service, we will take reasonable steps to minimise disruption and resume performance where possible. Mandatory consumer rights remain unaffected.

29. Complaints

If you are dissatisfied with a TMC programme, service or purchase, please contact us at kieranthemenopausecoach@gmail.com so that we can investigate. Please provide sufficient information to identify the relevant service and explain your concern.

30. Alternative Dispute Resolution (ADR)

If we cannot resolve your complaint through our complaints process, you may be able to use an alternative dispute resolution (ADR) service. ADR involves an independent third party helping to resolve a dispute without going to court. You can find information about approved ADR providers at the UK Government’s online ADR portal (https://www.gov.uk/guidance/alternative-dispute-resolution-for-consumers) or through the Ombudsman Services. We are not currently obliged to participate in a particular ADR scheme, but we will consider any reasonable request to use one. This does not affect your statutory right to take court proceedings.

31. Governing Law

These Terms and any contractual or non-contractual dispute or claim arising out of or in connection with them, their subject matter or formation, shall be governed by the laws of Northern Ireland. Nothing in this section is intended to deprive a consumer of mandatory legal protections that apply to them and cannot lawfully be excluded by agreement.

32. Jurisdiction

Subject to any mandatory consumer rights concerning jurisdiction, the courts of Northern Ireland shall have jurisdiction in relation to disputes or claims arising out of or in connection with these Terms, the Website or TMC services. Where applicable consumer law gives you a mandatory right to bring proceedings in another competent court, nothing in these Terms removes that right.

33. General Provisions

If any provision is found invalid, unlawful or unenforceable, the remaining provisions continue in effect to the extent permitted by law. A delay in enforcing a provision is not a waiver. These Terms, together with programme-specific terms, the Privacy Policy, any applicable cancellation/refund policy and other terms expressly incorporated into your purchase, form the agreement concerning the relevant service. Nothing limits liability for fraud or rights that cannot legally be excluded.

We may transfer our rights and obligations under these Terms to another organisation (for example, on a sale or restructuring of the business), and will notify you if this happens. You may not transfer your rights or obligations under these Terms without our prior written consent.

34. Changes to These Terms

We may update these Terms to reflect changes to services, our business, applicable law, technology, payment or delivery arrangements, or regulatory requirements. The latest version will be published on the Website with an updated revision date. Changes will not retrospectively remove contractual or statutory rights that have already arisen. Where a material change affects an ongoing paid service, we will take reasonable steps to bring it to affected customers' attention where appropriate.
